Chapter 11 - The Desperate Search and the Arrogant Lawsuit

Driven by financial desperation and wounded narcissism, Nathan launched one final, pathetic counter-offensive.

Believing that I was hiding out with Oliver and scraping by on Gabriel's handouts, Nathan filed an aggressive, bad-faith lawsuit in San Francisco Family Court. He demanded sole physical custody of Oliver, full spousal support from our marital estate, and twenty-five thousand dollars a month in "temporary maintenance," claiming that my "abrupt abandonment" had caused him severe emotional distress that prevented him from working.

His court filing was an absolute work of fiction. He portrayed himself as a doting, heartbroken father who had been victimized by an unstable, vindictive wife who had kidnapped his child.

The morning the court summons was served at my Sausalito home, Gabriel sat across from me at the kitchen table, drinking black coffee and laughing out loud as he read through Nathan’s claims.

"He’s claiming he supported you entirely and that you have zero earning capacity," Gabriel chuckled, shaking his head. "He’s asking the judge to order you to pay his attorney fees because he claims you have no viable legal defense."

"Let him believe that, Gabe," I smiled, lifting Oliver into his highchair and feeding him mashed organic avocados. "When is the formal evidentiary hearing?"

"Two weeks from today," Gabriel replied. "Judge Victoria Sterling is presiding. She’s one of the toughest, most no-nonsense family court judges in Northern California. She hates financial obfuscation, and she absolutely despises deadbeat parents who try to use custody as a weapon for alimony."

"Good," I said, wiping a dab of avocado from Oliver's chin. "Make sure our financial disclosures are submitted under seal until the morning of the hearing. I want Nathan to walk into that courtroom fully convinced he’s about to bully a broken housewife."

During the two weeks leading up to the hearing, Nathan’s attorney, a sleazy, bottom-tier divorce lawyer named Bradley Vance (no relation to Marcus), sent weekly settlement demands.

If your client surrenders sixty percent of the pre-marital asset proceeds and signs a non-disclosure agreement protecting Mr. Whitaker’s business reputation, Bradley Vance wrote, Mr. Whitaker will magnanimously agree to joint legal custody and waive his claim for retroactive spousal support.

Gabriel’s response to every single settlement demand consisted of just three words:

See you in court.

Nathan’s arrogance began to turn into frantic paranoia. He attempted to contact me directly through burner numbers, leaving desperate voicemails alternating between furious threats and pathetic apologies.

"Hannah, please, we can work this out," his recorded voice pleaded on one voicemail. "You don't understand what Serena did to me. She tricked me! I was doing all of that for us, for Oliver’s future! You need to drop the fraud evidence and come home. We can be a family again."

May you like

I listened to the recording once, saved the audio file to the court evidence folder, and deleted the message from my phone.

Nathan still believed that this was about emotions, hurt feelings, or jealousy. He could not fathom that this was about justice, accountability, and the absolute protection of my son.
