Chapter 6 - The Freezing Order That Blew the Doors Off

Back in Courtroom 4B, the silence stretched so thin it felt as though the air itself might shatter.

Judge Hartman set Daniel’s sworn financial affidavit aside with two fingers, treating it like a piece of contaminated waste. He folded his hands atop the bench and fixed his gaze squarely on Mitchell Crane.

“Mr. Crane,” Judge Hartman said, his voice deceptively level. “Your client has submitted a sworn declaration to this court attesting, under penalty of criminal perjury, that he had no undisclosed domestic or foreign accounts, that his total liquid net worth was under one hundred thousand dollars, and that no substantial marital property had been transferred outside the ordinary course of business.”

Crane stood up, his face glistening with a thin sheen of sweat. “Your Honor, these documents... we have not had adequate time to verify the authenticity of the supplemental exhibits submitted by the respondent. There may be context regarding corporate restructuring, legitimate tax mitigation strategies, and family estate planning that have not been properly presented—”

“Context?” Judge Hartman cut in, his eyes narrowing behind his spectacles. “Mr. Crane, does the ‘context’ include why a two-hundred-and-forty-seven-thousand-dollar wire was sent directly to a newly formed entity belonging to your client’s mother forty-eight hours after he was served with divorce papers? Does the ‘context’ explain why corporate funds were used to buy a fourteen-thousand-dollar diamond bracelet for an independent contractor who appears to be living in the penthouse your client leases under an undisclosed corporate subsidiary?”

Brianna Hale sank into her chair, pulling her designer blazer tightly around herself as if trying to disappear into the upholstery.

“Your Honor,” Daniel blurted out, jumping to his feet against his lawyer’s frantic hand gestures. “Clara has hacked my private business communications! She stole proprietary company data! She had no legal right to access those internal accounting files!”

Judge Hartman picked up his wooden gavel and brought it down with a thunderous CRACK that made Margaret Foster jump in her seat.

“Sit down, Mr. Foster!” the judge commanded, his voice echoing off the high plaster ceilings. “You will not speak out of turn in this courtroom again, or the bailiff will seat you in a holding cell until this hearing concludes!”

Daniel collapsed back into his leather chair, his chest heaving, his face burning a dark, mottled crimson.

Judge Hartman looked down at the court clerk. “Let the record reflect that this court finds substantial, credible evidence of intentional, bad-faith dissipation and fraudulent concealment of marital assets by the petitioner, Daniel Foster. Based on the documentation provided in the respondent's supplemental filing, this court is entering immediate, emergency relief.”

The judge picked up his pen and began dictating orders with machine-gun speed:

“First: An immediate, comprehensive freezing order is hereby placed on all domestic accounts associated with Daniel Foster, Foster Development LLC, MHF Holdings LLC, and Hale Strategic Media LLC, effective immediately. No funds exceeding five hundred dollars may be withdrawn or transferred without prior written approval from this court.

Second: The petitioner is ordered to surrender his passport to the clerk of court within twenty-four hours, pending verification of the offshore holdings identified in the Nevis jurisdiction.

Third: This court appoints an independent, court-certified forensic receiver—Marcus Vance of Vance & Associates—at the sole expense of the petitioner, to take immediate operational control of all financial books, records, bank accounts, and tenant revenue streams belonging to Foster Development LLC.

Fourth: The petitioner is ordered to pay the sum of forty-five thousand dollars directly to respondent’s counsel within seventy-two hours as an interim attorney fee sanction for bad-faith conduct.

And fifth: The clerk of this court is formally directed to transmit a certified copy of this proceeding, along with the petitioner's sworn financial affidavit and Exhibit D, directly to the Office of the District Attorney and the Special Investigations Unit of the Internal Revenue Service for evaluation of potential criminal perjury and tax fraud.”

When the words District Attorney and Internal Revenue Service left Judge Hartman’s lips, Margaret Foster let out a low, strangled cry and buried her face in her manicured hands.

Brianna turned to Daniel, her voice trembling with unmistakable panic. “Daniel... what does he mean by freezing the accounts? What about my consulting checks? What about my car lease?”

May you like

Daniel didn't answer her. He sat frozen, staring at me across the aisle with eyes full of sheer, unadulterated terror.

For the first time in twelve years, the man who had treated me like an expendable ghost was seeing who I truly was.
