Chapter 10 - The Custody Threat That Backfired

Thursday morning, 10:00 a.m.
Family Court Part 4, Manhattan Supreme Court.
Rowan and Selina sat at the petitioner’s table beside their lawyer, Arthur Pendelton—a flashy man in an overly tailored pinstripe suit who smelled of cheap aftershave. Rowan was wearing his only remaining clean suit, trying his best to look like a heartbroken, dignified young father. Selina sat beside him, dabbing imaginary tears from her eyes with a lace handkerchief.
Across the aisle, I sat calmly with my lead attorney, Eleanor Vance (a top-tier family law litigator who happened to be my late mother’s cousin), and Gideon Sterling.
Judge Evelyn Harrison, a no-nonsense jurist with thirty years on the bench, adjusted her reading glasses and slammed her gavel down.
“We are here regarding an emergency petition for temporary custody and parental establishment filed by Rowan Miller regarding the infant child, Leo,” Judge Harrison stated. “Mr. Pendelton, you have five minutes to justify why this emergency hearing was granted on four hours’ notice.”
Pendelton stood up, puffing out his chest.
“Your Honor, this is a tragic case of extreme parental alienation,” Pendelton proclaimed theatrically. “My client, Rowan Miller, is a hardworking, devoted husband and father. On the night his son was born, the respondent, Phoebe Sterling—formerly Vance—intentionally concealed her labor, fled to an undisclosed hospital, and conspired with her billionaire father, Gideon Sterling, to exclude Mr. Miller from the delivery room!”
Selina let out a theatrical, trembling sob from the table.
“Furthermore,” Pendelton continued, waving his arms, “the respondent deliberately omitted Mr. Miller’s name from the birth certificate in a malicious attempt to strip him of his fundamental constitutional rights as a father! We are asking for immediate temporary sole custody, supervised visitation for the mother pending a psychiatric evaluation, and reasonable interim spousal and child support of one hundred and fifty thousand dollars per month!”
Judge Harrison looked down from the bench, her expression unreadable. She turned her gaze to Eleanor Vance.
“Counsel for the respondent. What is your response?”
Eleanor stood up with calm grace. “Your Honor, Mr. Pendelton’s narrative is a complete, fabricated fantasy. We have three pieces of evidence to present to this court.”
“Objection! Hearsay!” Pendelton barked.
“Overruled. I haven’t even seen the evidence yet, Mr. Pendelton,” Judge Harrison snapped. “Proceed, Ms. Vance.”
“First,” Eleanor said, handing a certified thumb drive to the bailiff, “we submit the complete digital audio recording and telecommunication logs from the night of October 24th. This recording contains the exact conversation between Mr. Miller, his mother, and Mrs. Sterling while Mrs. Sterling was experiencing active labor contractions at St. Jude’s Hospital.”
Rowan’s eyes widened in sheer panic. He grabbed Pendelton’s sleeve, whispering frantically, but Pendelton shook him off.
“Play Exhibit A,” Judge Harrison ordered.
The courtroom speakers crackled to life.
Rowan’s voice echoed through the high-ceilinged room with crystal clarity:
“Handle it yourself, Phoebe. Stop being so dramatic.”
Selina’s mocking tone followed:
“Tell her women have been giving birth in fields for thousands of years... Don’t ruin my special evening.”
Rowan’s callous laughter rang out:
“See? Mom gets it. Call a cab. Enjoy the cake.”
The silence that followed the recording was absolute.
Judge Harrison’s face had hardened into stone. She slowly looked over the top of her glasses directly at Rowan, whose head was practically touching the table in shame.
“Mr. Miller,” Judge Harrison said, her voice dropping into a terrifyingly low register. “Did you, or did you not, utter those words to your wife while she was in active labor?”
“Your Honor... it was taken out of context...” Rowan stammered, trembling from head to toe.
“Do not insult my intelligence, sir,” Judge Harrison warned.
“We also submit Exhibit B,” Eleanor Vance continued smoothly. “The complete forensic report detailing Mr. Miller’s pending federal indictments for identity theft, corporate fraud, and the unauthorized opening of credit lines in his wife’s name. As well as Exhibit C: certified documentation that Mr. Miller is currently under investigation by the Department of Justice for international money laundering.”

At the back of the courtroom, the heavy oak doors opened. Two federal agents in dark suits walked in quietly and stood in the gallery, their badges clearly visible.
Selina looked back, saw the agents, and let out a genuine scream of pure terror.
